This Privacy Policy ("Policy") describes how Jaynam Modi, sole proprietor trading as Exactable ("Exactable", "we", "us", or "our") collects, uses, discloses, and protects personal data of visitors to https://exactable.in (the "Website") and individuals who interact with us through the Website or its associated subdomains (such as courtexa.exactable.in, maya.exactable.in, etc.) (collectively, "you"). This Policy is issued in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and other applicable Indian law.

This Policy applies to the Website and its subdomains. It does not extend to independently operated digital products developed by Exactable that maintain their own separate, product-specific privacy policies.

BY USING THE WEBSITE OR ITS SUBDOMAINS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS POLICY.

2. Personal Data We Collect

2.1 Information You Provide Directly

  • Contact / Project Enquiry Form: name, email address, phone number, country, area of service interest, and a description of your project.
  • Careers / Job Applications: name, email address, phone number, resume/CV, cover letter, and any other information you voluntarily include in your application, whether submitted to careers@exactable.in or via the Website.
  • Interviews and Assessments: notes, feedback, recordings (where applicable), assessment or test results, references, and other information gathered during interviews, evaluations, or discussions conducted as part of our recruitment or engagement process.
  • Other Correspondence and Interactions: any information you include in emails, WhatsApp messages, calls, meetings, or any other interaction with us.

2.2 Information Collected Automatically

When you visit the Website or its subdomains, we and our service providers may automatically collect:

  • device and browser information (type, operating system, IP address, and approximate location derived from IP address);
  • usage data, such as pages visited, time spent, referring and exit pages, and links clicked, collected via Google Analytics or similar analytics tools;
  • advertising and cookie identifiers collected via conversion tracking and remarketing tags deployed across advertising platforms we use from time to time, including but not limited to Google Ads, Meta/Facebook Ads, LinkedIn Ads, and other advertising networks. These are used to measure the performance of our advertising and to show you Exactable advertisements on other websites and platforms you subsequently visit.
  • cookies and tracking technologies set by third-party advertising networks (including Google AdSense, Meta Audience Network, and other ad networks) when you visit subdomains of Exactable (such as courtexa.exactable.in, maya.exactable.in, etc.) that display third-party advertisements.

2.3 WhatsApp

If you contact us using a WhatsApp link (wa.me) on the Website, your phone number and messages are also processed by WhatsApp/Meta in accordance with WhatsApp's own privacy policy, which we encourage you to review separately.

3. Cookies and Similar Technologies

3.1 The Website and its subdomains use the following categories of cookies:

3.4 Personalized Advertising and Opt-Outs: Our advertising platforms' use of advertising cookies is governed by each platform's own policies. Third-party vendors, including but not limited to Google, Meta, and LinkedIn, use cookies to serve advertisements based on your prior visits to the Website or subdomains. You may opt out of personalized advertising by visiting:

3.5 Google AdSense and Third-Party Ad Serving: We display third-party advertisements on subdomains and products associated with Exactable (such as courtexa.exactable.in, maya.exactable.in, etc.). Google's use of advertising cookies enables it and its partners to serve ads to our users based on their visits to our sites and/or other sites on the Internet. Users may opt out of personalized advertising by visiting Google's Ads Settings (https://adssettings.google.com).

4. How We Use Your Personal Data

We use personal data collected through the Website and subdomains to:

  • respond to your Enquiries and provide information about our Services;
  • evaluate job applications and communicate with candidates;
  • operate, maintain, and secure the Website and subdomains;
  • analyse Website and subdomain usage to improve our Website, subdomains, and Services;
  • run and measure the effectiveness of our advertising campaigns across any advertising platforms we use from time to time, including remarketing to prior visitors;
  • serve third-party advertisements, including personalized and interest-based advertisements, on our subdomains and products (e.g., courtexa.exactable.in, maya.exactable.in, etc.) via Google AdSense, Meta Ads, and other advertising platforms;
  • comply with applicable legal and regulatory obligations;
  • where you have separately consented, send you updates about our Services.

6. Disclosure of Personal Data

We do not sell your personal data. We may share personal data with:

  • service providers who support our Website and subdomains, including website hosting/platform providers, analytics providers (e.g., Google Analytics), and advertising partners/networks (such as Google Ads, Google AdSense, Meta/Facebook Ads, LinkedIn Ads, and other ad networks we use from time to time), each acting as our processor and bound to use your data only as instructed by us;
  • our professional advisors (legal, accounting), where necessary;
  • government or regulatory authorities, where required by applicable law;
  • a successor entity, in the event of a merger, acquisition, or sale of business assets, subject to equivalent data protection commitments.

7. Cross-Border Data Transfer

Some of our service providers, including Google and our website hosting infrastructure, may process personal data on servers located outside India. The DPDP Act permits the transfer of personal data outside India except to countries specifically restricted by the Central Government of India. We take reasonable steps to ensure that any personal data transferred outside India is subject to appropriate contractual and technical safeguards.

8. Data Retention

  • Enquiry Form Data: retained indefinitely, or until you request deletion, unless it develops into a client engagement, in which case it will be retained in accordance with the resulting services agreement and applicable law.
  • Job Application Data: retained indefinitely for consideration for future openings, unless you request earlier deletion.
  • Analytics, Advertising, and Ad Serving Data: retained in accordance with the default retention settings of the relevant provider (e.g., Google Analytics, Google AdSense, and Google Ads), or as otherwise configured by us.
  • We may retain personal data for longer periods where required to comply with legal, accounting, or regulatory obligations.

9. Data Security

We implement reasonable technical and organisational security safeguards, including access controls and secure data transmission, to protect your personal data against unauthorised access, alteration, disclosure, or destruction, as required under Section 8(5) of the DPDP Act. No method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

10. Your Rights as a Data Principal

Under the DPDP Act, you have the right to:

  • obtain a summary of the personal data we hold about you and the processing activities undertaken;
  • request correction, completion, and updating of your personal data;
  • request erasure of personal data that is no longer necessary for the purpose for which it was collected, subject to our legal retention obligations;
  • withdraw your consent at any time, with the withdrawal being as easy as giving consent, with effect for future processing (withdrawal does not affect the lawfulness of processing carried out before withdrawal);
  • nominate another individual to exercise these rights on your behalf in the event of your death or incapacity;
  • file a grievance with us and, if unresolved, escalate it to the Data Protection Board of India (DPBI) once it is fully operational.

To exercise any of these rights, contact our Grievance Officer at grievances@exactable.in. We will respond as expeditiously as possible and in any event within the timelines prescribed under the DPDP Act and rules made thereunder.

11. Children's Data

The Website, subdomains, and our Services are intended for business and professional use by individuals who are 18 years of age or older. Under the DPDP Act (Section 9), we do not knowingly collect personal data of children (defined as individuals under 18 years of age) or persons with disability for whom consent has not been provided by their lawful guardian. We do not engage in any processing of children's personal data that is likely to cause harm to the child, nor do we track, monitor behavior, or serve targeted behavioral advertisements to children on any of our sites, subdomains, or products. If we become aware that we have inadvertently collected child data without appropriate parent/guardian consent, we will delete it promptly.

13. Changes to This Policy

We may update this Policy from time to time. Material changes will be reflected by an updated "Effective Date" at the top of this Policy. We encourage you to review this Policy periodically.
