These Terms must be read together with our Privacy Policy, which is incorporated herein by reference. In the event of any conflict between these Terms and the Privacy Policy, these Terms shall prevail with respect to matters of Website and Subdomains use, and the Privacy Policy shall prevail with respect to matters of personal data handling.

2. About Exactable, Subdomains, and This Website
2.1 Exactable is a strategic services and technology consultancy. This Website describes the Services and provides a means for prospective clients and candidates to contact us.
2.2 Exactable develops and operates independent Products hosted on its Subdomains. Certain Products or Subdomains (e.g., courtexa.exactable.in, maya.exactable.in) may be governed by their own specific terms of use, end-user license agreements (EULAs), and product-specific privacy policies published on those platforms. In the event of a conflict between these Terms and the product-specific terms, the product-specific terms shall prevail with respect to your use of that specific Product or Subdomain. Otherwise, these Terms serve as the baseline governing agreement for all access to exactable.in and its Subdomains.
2.3 The information on this Website is provided for general informational purposes only and does not itself constitute an offer capable of acceptance. No client engagement, service relationship, retainer, or contractual obligation of any kind arises from browsing this Website or submitting an Enquiry. Any actual engagement for Services is governed exclusively by a separate, signed services agreement, statement of work, or equivalent written instrument executed between Exactable and the client.
3. Eligibility
By using the Website or Subdomains, you represent and warrant that:

5. Enquiries and Project Submissions
5.1 The Website includes a contact and project enquiry form through which you may submit your name, email address, phone number, country, area of service interest, and a description of your project.
5.2 By submitting an Enquiry, you consent to Exactable contacting you by email, telephone, or WhatsApp to respond to your Enquiry.
5.3 Submitting an Enquiry does not create any obligation on Exactable to accept the engagement, and does not create any exclusivity, retainer, or binding commitment on either party. Any engagement will only take effect upon execution of a separate written services agreement.
5.4 Please do not include highly sensitive or confidential information in an Enquiry beyond what is reasonably necessary to describe your project. Formal confidentiality protections apply only once a non-disclosure agreement or services agreement has been executed between the parties.
6. Careers and Job Applications
6.1 The Website and Subdomains may list open roles and permit you to submit a resume/CV, cover letter, and related information, including via careers@exactable.in.
6.2 Submission of a job application does not guarantee review, an interview, or an offer of engagement or employment.
6.3 You represent that all information in your application is accurate and complete. Misrepresentation may result in disqualification at any stage.
6.4 Personal data submitted as part of a job application is handled in accordance with our Privacy Policy.
7. Intellectual Property
7.1 All Content on the Website, Subdomains, and Products, including text, graphics, the Exactable name and logo, brand assets, and design elements, is owned by or licensed to Exactable and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws.

12. Governing Law and Dispute Resolution
12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
12.2 Jurisdiction: Subject to Section 12.3, any dispute arising out of or relating to these Terms, the Website, or the Subdomains shall be subject to the exclusive jurisdiction of the competent courts at Daman, India.
12.3 Informal Resolution: Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute informally by written notice to grievances@exactable.in, and to negotiate in good faith for 30 days from such notice before proceeding to formal legal action.
13. Changes to These Terms
Exactable may amend or update these Terms at any time by posting the revised Terms on the Website and Subdomains with an updated effective date. Continued use of the Website or Subdomains after such changes take effect constitutes acceptance of the revised Terms.
14. General Provisions
14.1 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Exactable regarding use of the Website and Subdomains.
14.2 Severability: If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary or severed, without affecting the remaining provisions.
14.3 Waiver: No failure or delay by Exactable in exercising any right under these Terms shall operate as a waiver of that right.

14.6 No Partnership: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Exactable.
14.7 Language: These Terms are executed in the English language, which shall prevail over any translated version.
